HARRIET MIERS: JUDGEMENT DAY

SUPPORTERS OF ROE V WADE CAN GO TO HELL or they may find a similar fate here on political earth [story]  John Fund in the WSJ reports what has previously been suspected.  Harriet Miers has indicated she would overturn Roe.

Two days after President Bush announced Harriet Miers's Supreme Court nomination, James Dobson of Focus on the Family raised some eyebrows by declaring on his radio program: "When you know some of the things that I know--that I probably shouldn't know--you will understand why I have said, with fear and trepidation, that I believe Harriet Miers will be a good justice."

Mr. Dobson quelled the controversy by saying that Karl Rove, the White House's deputy chief of staff, had not given him assurances about how a Justice Miers would vote. "I would have loved to have known how Harriet Miers views Roe v. Wade," Mr. Dobson said last week. "But even if Karl had known the answer to that--and I'm certain that he didn't because the president himself said he didn't know--Karl would not have told me that. That's the most incendiary information that's out there, and it was never part of our discussion."

It might, however, have been part of another discussion. On Oct. 3, the day the Miers nomination was announced, Mr. Dobson and other religious conservatives held a conference call to discuss the nomination. One of the people on the call took extensive notes, which I have obtained. According to the notes, two of Ms. Miers's close friends--both sitting judges--said during the call that she would vote to overturn Roe.

QUESTIONABLE JUDGEMENT If the news on Miers's opinion on Roe getting out, the news on that news is worse.  The White House again denies small details, but is found lying on the larger truth.  Doctor Dobson did get a house call and given the diagnosis on Miers.  An ill boding for increasingly white faces in the White House.

NOT TAKING THE PITCH [Steve Soto/ The Left Coaster] So, if you were running a campaign to overcome doubts amongst your evangelical base that your unqualified Supreme Court nominee wasn’t conservative enough, what would you do? . . . .Memo to Dems: Don’t go for the pitch in the dirt. Pin her down on this at the hearing and don’t give the wingnut base any reason to get engaged on this fight any sooner than you have to.

THE HERETIK AGREES Miers needs to be pinned down as much as she can be on Roe.  But with the reality that nominees are well versed in giving opinions on why they cannot give opinions on their opinions, it would seem easier said to pin down Miers than done.  The White House is working hard to play down the religion they first played up to their legions on the right. Now they go with Harriet 2.0.  The White House gets a zero for misplay so far and should be glad they aren't further into negative numbers.

That's what I've thought all along. The faux right-wing rage against Miers is merely a Rovian distraction. She'll be confirmed, and the wire-hanger industry will be better off for it.

I dunno - I think that Bush is smelly, and Harriet bears a whiff of the scent. They could Bork her and actually get away with it.

Roberts could pass as a moderate, but, in order to be confirmed, Miers must be far right. But if she's far right, she won't be confirmed.

The White House is in quite a bind.
